The Living Law

FÉINE — the freemen

The free kindred. The land-tillers. The folk. The law is named after them. The law belongs to them. They are the law.

FÉNECHAS — the law of the féine

Oral tradition spanning at least one thousand years before a single word was written down. Roots stretching to c. 1000 BCE. The oldest continuously documented law in Europe. Not a code. Not a statute. The living law.

DERBFINE — the true kin

Four generations. Common great-grandfather. The unit of holding. The unit of answerability. Land belongs to the derbfine. A king cannot sell it. Cannot give it away. It belongs to the people.

FOLCRIHT — the right of the folk

Old English. The same law. The same standard. King Edgar, 959: "In the hundred, as in any other gemot, we ordain that folkright be pronounced in every suit." The structure is the same. The plumb line does not change.

MELCHIZEDEK — the pattern

King of Salem. Priest of God Most High. Without father, mother, genealogy, beginning, end. The oikos held by the mægþ. The righteousness that precedes the law. Man is endowed. Not granted. The law is the expression of what the man already is.

One law. Laid down. Not made. Not enacted.
The natural state of man.
The freeman is endowed. The law expresses it.

The Law

One law. God's law.

All law derives from one source. Not a king. Not a parliament. Not a constitution. The law that is laid down before any of them drew breath.

Every people who keeps it calls it by their own name. The Celtic freemen — fénechas. The Anglo-Saxon folk — folcriht. The structure is the same. The standard is the same. The plumb line does not change.

"I will set a plumb line in the midst of My people." — Amos 7:8

"That they meet always within four weeks: and that every man do justice to another." — Ordinance of the Hundred, King Edgar, 959

It is the norm. It is the default.
That is why it was erased.

The Hundred

Justice is done in the open.

Under an oak. On a green. At a crossroads. No walls. No docket. No "court."

The hundred moot meets every four weeks. A hundred households. A reeve presiding. Twelve men witness every sale of land, cattle, and manumission. Not a jury. Witnesses. The sīþ makes the transaction real.

The brithem recites. He does not create. The community accepts or rejects. The shire moot meets twice a year. The folcegemot is the whole community. The witan is the king's council. The law is spoken. The folk holds it.

The usurper took the word "moot" and made it mean irrelevant.
The usurper took the word "doom" and made it mean a state court's sentence.
Both words are buried. Both words are yours.

The Bee

The bee has a line.

The Bechbretha. Europe's oldest bee law. c. 650–750 CE. The hive is kin. Not a resource. Answerable. Part of the oikos.

Bees foraging on a neighbor's land: grazing trespass. Same as a cow straying. The hive is stolen: same severity as stealing from inside a house.

Rome calls the bee ferae naturae — wild. Ownerless. The folk calls it held. The usurper reclassified the bee as wild. Then he did the same to the man.

The bee has more standing than the citizen.
The swarms are advancing Gods Earth Order.

The Fein

The usurper took the word féine
and turned it into fein.

The freeman is the enemy. The man who holds the law is the man against whom force is justified.

The state manufactures its own enemy. Every birth registered is a fiction. The birth certificate is the death certificate for the féine and the birth certificate for the fein. One document. Two deaths. One birth. The flesh man dies. The paper man is born. And the paper man is the enemy the state needs to justify the sword.

The state's kratos is borrowed. Borrowed from the fear of the féine. Remove the fear and the kratos is a shadow. The sword has nothing to cut. The prison has nothing to hold.

The féine is the freeman.
The fein is the fiction.
The fiction is dead.

The Nature

The law is not made.
The law is laid down.

The Conquest killed the moot. The Conquest killed the sīþ. The Conquest killed the dōm. The Conquest did not kill the law.

The law is not in the assembly. The law is in the bee. The law is in the swarm. The law is in the way the land holds. The law is in the Jubilee — the reset God built into the soil. Every fiftieth year. The land breathes.

You can kill the assembly. You cannot kill the order. You can burn the Senchus Már. You cannot burn the bee. You can outlaw the sīþ. You cannot outlaw the way the swarm returns.

The law is woven into nature by Nature's God.
It cannot be murdered. It can only be forgotten.
Fénechas is alive.

Enforcement

No state. No prison. No police.

The tithing — ten men bound together. A breach by one is a breach by all.

The hue and cry — the victim raises the voice, and every able man in the vicinity is obligated to pursue.

Wergild — compensation calibrated to the offense. The goal is to restore peace. Not to inflict suffering.

Outlawry — the ultimate sanction. A man who cannot or will not pay is put out of law. Utlaġa. No longer protected.

The folk enforces the folk.

The Record

The writing came.
The law did not begin with it.

The Senchus Már — "The Great Tradition." 7th–8th century. The oldest Irish compilation. The law it records is far older.

The Dooms of Æthelberht of Kent, c. 600. The earliest written Anglo-Saxon law code.

The Grágás — written down c. 1118. Preserves Norse custom centuries older than the ink.

The writing came. The law is already there.

The Vault

Three lines. One root.

Three branches. One root. Each one carries the law forward in its own tongue. Take it. Pass it to your children.

The Rabbit

The rabbit sits in the clearing.
Smoking a pipe. Unafraid.

The smoke is the sīþ. The oral law. The breath. Cannot be written down. Cannot be taken. Cannot be killed.

The lynx has the teeth. The rabbit has the arkhe. The lynx has a counterfeit kratos. Dēmokratos. Aristokratos. Autokratos. Oligokratos. The state cycles through them all. None of them is kratos. They are the mob's fear. The few's greed. The one's lust. The rabbit has the real thing. Exousia. Dynamis. Kratos. The sword. The fire. The unbreakable will. The lynx is a corpse. The lynx has no ealdor. The rabbit IS the living.

The rabbit does not fight the lynx.
The rabbit remembers.
The law is alive. Long live Gods earth order.

ᛏ

The Jubilee is sounded.

The land remembers. The blood remembers. The name remembers.

Return to your authority.
